Attorney review required. This document covers the material terms but has not been reviewed by legal counsel. This product makes financial projections that could influence a real purchase decision — the liability limitations and data accuracy sections in particular should be reviewed by an attorney before this document is treated as binding.
OMPT Velocity ("the Service") is a subscription-based solar proposal generation tool. Users submit a commercial property address; the Service generates a PDF report containing solar production estimates, savings projections, and financing scenarios. Proposals are produced using third-party data sources including Google's Solar API and U.S. Energy Information Administration (EIA) commercial electricity rate data.
Proposals generated by the Service are estimates only. They are not engineering reports, site assessments, or professional opinions. They are not a substitute for a formal site survey by a licensed solar installer.
AI-generated content (savings analogies, narrative framing) is produced by a large language model. This content is illustrative and may not reflect the specific circumstances of a given property or buyer.
2.1 Billing. Subscriptions are billed monthly. Your billing cycle begins on the date of your first payment and renews on the same calendar date each month.
2.2 Plan limits. Each plan includes a monthly proposal allowance:
2.3 Cap exemption. Two categories of proposal attempts are not counted against your monthly allowance:
(a) Long payback: Proposals for which the Service calculates an estimated payback period exceeding 40 years are not counted against your monthly allowance. These proposals are generated and delivered normally; only the billing accounting is affected. The payback period used for this determination is calculated as estimated system cost divided by estimated annual savings, as derived from the data sources described in Section 4.
(b) Zero viability: Addresses for which the Google Solar API returns no viable panel configurations — meaning no PDF is generated and no proposal is delivered — are not counted against your monthly allowance. No charge is incurred for a generation attempt that produces no deliverable output.
2.4 Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
2.5 Tier changes. Plan upgrades take effect immediately. Plan downgrades take effect at the start of the next billing cycle.
3.1 Source data. Solar production estimates are sourced from Google's Solar API, which uses satellite imagery to model roof geometry and solar irradiance. Electricity rate estimates are sourced from EIA Table 5.6.B (commercial sector averages by state), updated periodically. These sources represent the best publicly available data; they are not site-specific measurements.
3.2 Estimates, not guarantees. All figures in generated proposals — including system size, annual production, annual savings, payback period, and cumulative savings — are estimates. Actual results will vary based on local conditions, installation quality, shading, equipment specifications, utility tariff structures, and other factors not captured by the data sources used.
3.3 Not a professional report. Proposals generated by the Service are not engineering reports, energy audits, or professional assessments of any kind. They are not intended to be relied upon as the sole basis for a purchase decision. A site survey by a licensed installer is required before any installation commitment.
3.4 PDF footer disclaimer. The following disclaimer appears on all generated proposals: "Estimates only. Actual production and savings vary. Solar data provided by Google. Not a formal engineering report." This disclaimer is part of the proposal and should not be removed or obscured when sharing proposals with third parties.
4.1 Description. Territory Intelligence Reports ("TI Reports") are one-time purchase data products that identify and rank commercial properties within a defined geographic area by estimated solar viability.
4.2 Data sources. TI Reports are produced using data from the National Renewable Energy Laboratory (NREL), OpenStreetMap (OSM), and the Utility Rate Database (URDB). These are public and government data sources. TI Report data is not sourced from Google's Solar API. Google's terms of service prohibit reselling or redistributing Solar API data; TI Reports are produced from entirely separate data sources to comply with this requirement. This distinction is material and intentional.
4.3 Exclusivity. Each TI Report covers a defined territory. Once a report is purchased for a given territory, that territory will not be sold to another buyer for 90 days from the date of purchase. Exclusivity applies to the same geographic territory definition; adjacent or overlapping territories are not covered by this restriction.
4.4 No refunds. TI Reports are delivered digitally and are non-refundable once generated.
You may use proposals generated by the Service to present solar opportunities to prospective customers on your own behalf. You may not: resell raw proposal data or API access; represent proposals as engineering reports or site assessments; remove or alter the disclaimer language in delivered proposals; use the Service to generate proposals for addresses you have no legitimate business interest in.
We reserve the right to suspend or terminate accounts that violate these terms, abuse the proposal generation system, or use the Service for purposes inconsistent with its intended use. Accounts terminated for cause are not eligible for refunds.
To the maximum extent permitted by applicable law, OMPT and its operators are not liable for any direct, indirect, incidental, or consequential damages arising from use of the Service, including but not limited to losses resulting from a prospect's reliance on a generated proposal, errors in underlying third-party data, or decisions made based on proposal estimates.
The Service is provided as-is. We make no warranty that proposals will be accurate, complete, or suitable for any particular purpose beyond what is described in these terms.
We may update these terms from time to time. Continued use of the Service after changes are published constitutes acceptance of the revised terms. Material changes will be communicated by email to the address on your account.
